Welcome to EllenWhiteAudio.org. By accessing or using our website and mobile applications (collectively, the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our Service.

1. About EllenWhiteAudio.org

EllenWhiteAudio.org is operated by Health Ministry Foundation, Inc., a 501(c)(3) nonprofit organization based in California.

2. Our Mission

Our mission is to provide free access to audio recordings of Ellen G. White’s writings and related Adventist pioneer materials in multiple languages, making these spiritual resources accessible to people worldwide.

3. Content Licensing and Copyright

The content available on EllenWhiteAudio.org is subject to the following licensing terms:

• Source Materials: A significant portion of the written materials are copyrighted by the Ellen G. White Estate. We produce audio content from these writings under license from the White Estate.
• Audio Recordings: Our audio recordings are made available under a Creative Commons license, with specific restrictions outlined in Section 4 below.
• Attribution: Users are strongly encouraged to provide proper attribution when sharing or promoting our content.

4. Permitted and Prohibited Uses

You MAY:

• Download and listen to audio files for personal, non-commercial use
• Share and distribute our content without alteration, in good faith, and in ways that positively represent the materials
• Use our content for educational and ministry purposes without charge
• Promote our content on your website or other venues with proper attribution

You MAY NOT:

• Alter Content: Modify, edit, or alter audio files to misrepresent what was originally said
• Commercial Use: Sell, monetize, or use our free content for commercial gain
• Misrepresentation: Use our content to create prejudice against or misrepresent Ellen White, Adventist pioneers, or the Seventh-day Adventist Church
• Negative Distribution: Distribute our content in bad faith or in ways that negatively portray the materials or their authors
• Copyright Violation: Remove or alter copyright notices or attribution information

5. User Accounts and Data Collection

We collect certain information to improve our Service and process donations:

• Email Addresses: Collected for donation receipts and occasional ministry updates
• Donor Mailing Addresses: Collected for donation receipts and occasional ministry updates
• Analytics Data: We collect anonymous usage data to understand how our Service is used and to improve user experience
• Download Tracking: We track which content is downloaded to better serve our users
• Payment Information: When you make a donation, payment information is processed securely through Stripe or PayPal. We do not store your complete payment card information on our servers.

We are committed to protecting your privacy. We will never sell, rent, or share your personal information with third parties for their marketing purposes.

6. Donations

EllenWhiteAudio.org is supported by voluntary donations. Your generosity enables us to continue providing free access to spiritual resources worldwide.

6.1 Tax Deductibility

Health Ministry Foundation, Inc. is a 501(c)(3) tax-exempt organization. Donations made by U.S. taxpayers are tax-deductible to the extent allowed by law. Tax receipts will be provided for all donations either individually or combined.

6.2 Payment Methods

We currently accept donations through the following methods:

• Credit/Debit Cards (via Stripe)
• PayPal
• ACH Bank Transfer (future implementation planned)
• Personal or Business Checks (made payable to “Health Ministry Foundation” with memo “EllenWhiteAudio”)
• Cash
• Transfer of Investments (stocks, bonds, mutual funds)
• Other methods we may deem appropriate

6.3 Use of Donations

Donations support the mission and operations of EllenWhiteAudio.org and related projects. Your contributions may be used for:

• Conference exhibits and evangelistic outreach activities
• Travel expenses related to ministry conferences and events
• Creation and hosting of conferences, lectures, and training events
• Equipment necessary for content creation and project operations
• Staff compensation and ministry team support
• Technology infrastructure (servers, hosting, content distribution, website maintenance, app development)
• Supporting similar ministries and collaborative projects
• Promotion of Adventist pioneers and Ellen White’s writings (awareness campaigns, printed materials, books, audio and video production, social media outreach, advertising, sermons, lectures, training programs)
• Scholarships to help young people attend conferences, lectures, and training events where biblical truth is presented
• Creation of multimedia content (audio recordings, video productions, translations)

6.4 Designated Donations

Health Ministry Foundation endeavors to honor your wishes that designate the use of donated funds. However, Health Ministry Foundation maintains control over the ultimate determination of how all donated funds are allocated. You should be aware that, although Health Ministry Foundation will make every effort to honor your contribution designation, contributions become the property of Health Ministry Foundation and it has the discretion to determine how best to use all contributions to carry out its functions and purposes.

6.5 Donation Policy

• All Donations Are Final: All donations are final and non-refundable, except as required by law. Once processed, donations cannot be returned.
• Right to Refuse: We reserve the right to refuse or return any donation at our sole discretion if we believe accepting it would compromise our mission, values, or legal obligations.
• Receipts: Donation receipts will be sent to the email address or mailing address you provide for tax purposes.
• No Goods or Services Provided: No goods or services have been provided to the donor in consideration of this donation, except intangible religious or spiritual benefits. The full amount of your donation is tax-deductible as allowed by law.

6.6 Recurring Donations

We offer both one-time and recurring monthly donation options.

• Automatic Billing: If you choose a recurring donation, your payment method will be automatically charged monthly until you cancel.
• Ongoing Authorization: By setting up a recurring donation, you authorize Health Ministry Foundation to automatically charge your selected payment method each month. This authorization will remain in effect until you cancel.
• Your Responsibility to Cancel: Recurring donations will continue indefinitely until you actively cancel them. You are responsible for canceling your recurring donation if you wish to stop automatic charges. We will not cancel recurring donations on your behalf unless you request it.
• How to Cancel: You may cancel your recurring donation at any time by:
  • Contacting us at contact@ellenwhiteaudio.org
  • Managing your subscription through your payment processor
  • Sending written notice to our mailing address
• Cancellation Timing: Cancellations must be received at least 5 business days before your next scheduled payment date to avoid being charged for that billing cycle. Once a payment has been processed, it cannot be refunded.
• Changes to Recurring Donations: If you wish to change the amount of your recurring monthly donation, you must cancel your existing recurring donation and set up a new one with your desired amount.
• Payment Failures: If a recurring payment fails due to insufficient funds, expired card, or other payment issues, we will attempt to process the payment again. Repeated payment failures may result in cancellation of your recurring donation. We are not responsible for failed payments due to issues with your payment method.
• Changes to Payment Method: It is your responsibility to update your payment information if your card expires or your payment details change. You can update this information through your payment processor or by contacting us.
• No Refunds for Past Payments: Past recurring donation payments cannot be refunded, even if you cancel future donations. Each recurring payment is processed as a separate, final donation.

6.7 Fraud Prevention and Unauthorized Transactions

• Card Security: You are responsible for maintaining the security of your payment method and account credentials. Do not share your payment information with others.
• Authorized Use Only: By making a donation, you represent and warrant that you are the authorized cardholder or account holder and have the legal right to use the payment method provided.
• Fraudulent Activity: We employ fraud detection systems to prevent unauthorized transactions, including card testing and other fraudulent activities. Suspicious transaction patterns may result in:
  • Temporary or permanent blocking of IP addresses
  • Rejection of donation attempts
  • Reporting to payment processors and appropriate authorities
• Chargeback Policy: If you dispute a legitimate donation charge with your credit card company or bank (chargeback), we reserve the right to:
  • Contest the chargeback with evidence of your authorization
  • Pursue collection of the disputed amount plus any chargeback fees incurred
  • Block future donations from you or your payment methods
  • Take legal action if fraud is suspected
• Unauthorized Charges: If you believe a charge was made without your authorization, contact us immediately at contact@ellenwhiteaudio.org before initiating a chargeback. We will investigate and work with you to resolve legitimate disputes.
• Card Testing: Any attempt to use our donation system for credit card testing, validation, or other fraudulent purposes is strictly prohibited and may result in:
  • Immediate blocking of access
  • Reporting to law enforcement and payment fraud networks
  • Legal prosecution to the fullest extent of the law
• Transaction Limits: We may impose limits on donation amounts, frequency, or total volume to prevent fraud. Multiple small donations in rapid succession may be flagged as suspicious activity.
• Verification Requirements: We reserve the right to request additional verification for any donation, including identification, proof of payment method ownership, or other documentation before processing.

7. Intellectual Property Rights

The EllenWhiteAudio.org name, logo, and website design are the intellectual property of Health Ministry Foundation, Inc. All rights not expressly granted in these Terms are reserved.

8. Third-Party Services

Our Service uses third-party services including:

• Stripe for payment processing
• PayPal for payment processing
• Analytics services for usage tracking

Your use of these third-party services is subject to their respective terms and conditions and privacy policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or other harmful components
• Downloaded content will be compatible with all devices

10. Limitation of Liability

To the fullest extent permitted by law, Health Ministry Foundation, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

12. Mobile Applications

If you access our Service through a mobile application:

• These Terms apply to your use of the mobile app in addition to any app store terms
• You are responsible for any mobile data charges incurred while using the app
• Updates to the app may be required for continued functionality
• We may discontinue mobile app support at our discretion

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission

14. Indemnification

You agree to indemnify, defend, and hold harmless Health Ministry Foundation, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

We reserve the right to terminate or suspend access to our Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Our Service may contain links to third-party websites or services that are not owned or controlled by Health Ministry Foundation, Inc. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with use of any such content, goods, or services available on or through any such websites or services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

19. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Siskiyou County, California.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

21. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

22. Entire Agreement

These Terms constitute the entire agreement between you and Health Ministry Foundation, Inc. regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
